who can tell me why?

I'm not to good in *nix systems but should there not be a '/' in front of the 'usr_image'.

It means your host has safe mode turned on, and that PHP is not allowed to open files that are in the directory where you're trying to read from. See the manual for details, but roughly: everything involved (source directory, target directory, file, and script) all have to have the same owner.

is $photo in the same directory as upload.php? because copy copies from a source to a destination.

I have similar error to 'hjunw' after fresh install of March Networks SME Server v5.1 (i.e. modified RedHat using PHP v4.0.4pl1/Apache v1.3.14). I'm just trying to include a text header and 'last modified' footer. The include files are in the same directory as prior to the upgrade (when the includes worked); safe mode is definitely OFF and the include-path directive in PHP.INI has been amended (and saved <grin>). Still get the same errors:-

Any help would be appreciated, e.g. where should I check next?

Hmm..well, I've kludged it for now by appending the location of each virtual domain's 'include' folder to the 'include-path' directive in PHP.INI. Had to change error reporting to OFF though so users didn't see results of the kludge. Not elegant but it works. (Is there any path length restriction to statements like in DOS?) There must be a better solution!
