ensure checkbox is selected before submitting form

i have an html form that i need to ensure that the checkbox is selected before the form is submitted. i have found client-side javascript for this but my delima lies in that the <head></head> tags that the javascript needs to be placed in does not reside on this page.
the form is actually printed in a header in form.php which loads through index.php?act=form

the javascript dosent have to be in the header.

place it just before your <?php line and I'd think it would work fine. then in your form use Onsubmit="the_return=yourfunction();" return=the_return
